Terms of Service

1. Agreement

By accessing or using LOKAL (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By creating an account, you represent and warrant that you meet this age requirement. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

3. Accounts and Security

You must provide accurate and complete information when creating your account. You are responsible for all activities that occur under your account. You must maintain the security of your account and promptly notify us if you discover any unauthorized use.

We may suspend or terminate your account if we believe you have violated these Terms, engaged in suspected abuse, or if required to protect the safety of our users or the integrity of the Service.

4. User Content

You retain ownership of all content you create and share through the Service (“User Content”), including posts, stories, photos, messages, and activity details.

By sharing User Content on the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works from, distribute, and display your User Content solely for the purposes of operating, developing, providing, and improving the Service, and sharing it with other users as you direct.

You represent and warrant that you have all necessary rights to the User Content you share and that your User Content does not violate any law, regulation, or third-party rights.

5. Community Rules

You agree not to:

• Harass, threaten, bully, intimidate, or exploit others.
• Post illegal, harmful, or offensive content, or content that violates others' rights.
• Impersonate any person or entity, or misrepresent your identity or affiliation.
• Attempt to access other users' accounts or bypass security measures.
• Use the Service to send spam, engage in scams, or solicit fraud.
• Share content that is sexually explicit, violent, or depicts the exploitation of minors.
• Reverse engineer, decompile, scrape, or interfere with the operation of the Service.
• Use automated tools, bots, or scripts to access the Service without our consent.
• Collect or harvest information about other users without their consent.

We may remove content and restrict or terminate accounts at our discretion to protect our community and enforce these Terms.

6. Safety Features

The Service includes safety tools such as reporting, blocking, and content moderation. We may review reported content and accounts to enforce these Terms. We use both automated systems and human review to detect and remove harmful content.

Users who are reported and found to have violated these Terms may have their content removed, their accounts restricted, or their accounts permanently banned.

7. Activities and Events

The Service allows users to create and join activities and events. By participating in activities:

• You are responsible for your participation, conduct, and safety.
• We are not responsible for the actions or behavior of other users, event organizers, or third-party venues.
• Activity creators are responsible for the accuracy of activity details and for managing their activities appropriately.
• If any payment features exist, additional terms may apply and refund and cancellation policies will be presented at the time of purchase.

8. Match Suggestions and Recommendations

The Service may recommend people, activities, or content using automated systems, including AI-powered features. These recommendations are suggestions only and are not guarantees of compatibility, safety, or quality. You are solely responsible for your interactions and decisions when engaging with recommended users or content.

9. Messaging

The Service provides messaging features with different retention modes. Messages may be saved, set to expire after 24 hours, or set to disappear after viewing, depending on the chat settings chosen by participants. You are responsible for the content of your messages.

Initial message requests may be analyzed by automated moderation systems to detect harmful content. If a message is flagged by moderation, it may not be delivered and a temporary cooldown may be applied to your account.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share your information. By using the Service, you consent to the practices described in our Privacy Policy.

11. Account Deletion

You may request deletion of your account at any time through the “Delete Account” option in the Settings section of the app. Upon requesting deletion:

• Your profile will be hidden from other users immediately.
• After 30 days, your account and all associated data (including posts, stories, messages, activities, follows, blocks, and notifications) will be permanently deleted.
• If you log back in within 30 days, your account will be reactivated and the deletion request will be cancelled.
• After the 30-day period, deletion cannot be undone.

12. Termination

You can stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, to protect the Service or its users, or to comply with law. Upon termination, your right to use the Service will cease immediately.

13. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by LOKAL and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

14. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

15. Limitation of Liability

To the maximum extent permitted by applicable law, LOKAL and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• User interactions, activities, or events facilitated through the Service.
• Unauthorized access, use, or alteration of your content or information.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to its conflict of law provisions.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the app or by other reasonable means. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
